This Return and Refund Policy applies to purchases made through CleverGekauft and is intended to comply with applicable European Union consumer protection laws, including the rules governing distance contracts and consumer sales.
Nothing in this Policy limits or excludes any mandatory rights that consumers may have under applicable national or European Union law.
1. Right of Withdrawal
If you are a consumer located in the European Union or European Economic Area, you generally have the legal right to withdraw from your purchase within 14 days without giving any reason.
For purchases of goods, the withdrawal period expires 14 days after the day on which you, or a third party designated by you other than the carrier, physically receives the goods.
Where multiple goods from one order are delivered separately, the withdrawal period generally begins when you receive the last item.
This statutory right is separate from any additional voluntary return rights that CleverGekauft may offer.
EU distance-sale rules establish this 14-day cooling-off period for most online purchases.
2. How to Exercise Your Right of Withdrawal
To exercise your right of withdrawal, you must inform us of your decision to withdraw from the contract through a clear statement before the withdrawal period expires.

You do not need to provide a reason for exercising your statutory right of withdrawal.
We will provide you with the necessary return instructions and, where applicable, the address to which the goods must be returned.
3. Returning the Goods
After notifying us that you wish to exercise your right of withdrawal, you must send the goods back without undue delay and no later than 14 days from the date on which you informed us of your decision to withdraw.
The deadline is met if you send the goods before the 14-day return period has expired.
Unless otherwise stated by us or required by applicable law, you are responsible for the direct cost of returning the goods when exercising your right of withdrawal.
Please contact us before returning any product so that we can provide the correct return address and instructions.
We strongly recommend using a trackable shipping method and retaining proof of shipment.
EU rules permit the consumer to bear the direct cost of a withdrawal return, provided the consumer was informed of this obligation in advance.
4. Condition of Returned Goods
You may inspect and handle the goods only to the extent necessary to establish their nature, characteristics and functioning, in the same way that you would reasonably be allowed to inspect them in a physical store.
You may be responsible for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
The mere opening of packaging does not automatically eliminate your right of withdrawal, except where a statutory exception applies.
This treatment of diminished value follows the EU Consumer Rights Directive.
5. Refunds Following Withdrawal
If you validly exercise your right of withdrawal, we will reimburse all payments received from you in connection with the withdrawn purchase, including the cost of our least expensive standard delivery option, where applicable.
If you selected a more expensive delivery method, such as express or premium shipping, we are not required to reimburse the additional amount above the cost of our standard delivery option.
Refunds will be made without undue delay and no later than 14 days from the date on which we are informed of your decision to withdraw.
For sales of goods, we may withhold the refund until:
(a) we have received the goods back; or
(b) you have provided evidence that you have sent the goods back,
whichever occurs first.
Unless expressly agreed otherwise, refunds will be made using the same payment method used for the original transaction, and you will not incur fees from us as a result of the reimbursement.
These timing and reimbursement requirements are set out in Article 13 of the EU Consumer Rights Directive.
6. Exceptions to the Right of Withdrawal
The statutory right of withdrawal does not apply in certain circumstances provided for by applicable law.
These may include, among others:
- Goods made to the consumer's specifications or clearly personalised;
- Goods that are liable to deteriorate or expire rapidly;
- Sealed goods that are not suitable for return for reasons of health protection or hygiene and that have been unsealed after delivery;
- Goods which, after delivery, are inseparably mixed with other items;
- Certain sealed audio, video or software products once unsealed;
- Digital content supplied without a tangible medium where performance has begun with the consumer's prior express consent and acknowledgement of the loss of the right of withdrawal, where legally applicable;
- Other products or services specifically excluded from the statutory right of withdrawal under applicable law.
An exception will only be applied where legally permitted.
7. Damaged, Defective or Incorrect Products
The statutory right of withdrawal described above is separate from your legal rights relating to defective or non-conforming goods.

Please provide your order number and a description of the issue. Photographs or videos may be requested where reasonably necessary to assess the problem.
Where the goods are legally considered defective or non-conforming, you may be entitled to remedies under applicable consumer law, including repair or replacement free of charge and, where the applicable legal conditions are met, a price reduction or refund.
We will not charge consumers return shipping costs for goods that must be returned because they are defective or non-conforming where the seller is legally responsible for those costs.
8. Legal Guarantee for EU Consumers
Consumers purchasing goods in the European Union benefit from a minimum two-year legal guarantee of conformity, starting from the date the goods are received.
If goods are defective, do not function as advertised, or otherwise fail to conform to the sales contract, consumers may have statutory rights to repair, replacement, price reduction or termination of the contract and reimbursement, depending on the circumstances and applicable national law.
Some EU Member States provide consumer rights that go beyond the minimum requirements established by EU law. Nothing in this Policy restricts those mandatory rights.
The European Commission confirms the minimum two-year legal guarantee and notes that individual EU countries may provide additional protection.
9. Return Shipping Costs for Defective Goods
Where a product is defective or non-conforming and applicable consumer law requires us to remedy the lack of conformity, the necessary costs associated with bringing the goods into conformity, including applicable shipping or transportation costs, will be borne by us.
You should contact us before returning a defective product so that we can provide appropriate instructions.
EU consumer guidance specifically states that remedies for defective products must be provided without cost to the consumer, including applicable shipping costs.
10. Lost or Undelivered Orders
If your order has not arrived within the expected delivery period, please contact us at support@clevergekauft.com.
Where we arrange delivery, responsibility for the goods generally remains with us until you or a third party designated by you acquires physical possession of them, subject to applicable law.
If a shipment is confirmed as lost or cannot be delivered as agreed, we will provide the remedy required by applicable consumer law, which may include replacement or reimbursement.
11. Refused or Unclaimed Deliveries
If a shipment is refused or remains unclaimed, please contact us.
Refusing delivery or failing to collect a parcel does not necessarily constitute a valid exercise of the statutory right of withdrawal. Consumers wishing to withdraw should clearly communicate their decision to us.
Any refund or deduction relating to an unclaimed or refused shipment will be handled in accordance with applicable mandatory consumer law.

14. Mandatory Consumer Rights
Nothing in this Return and Refund Policy is intended to exclude, restrict or modify any consumer right or remedy that cannot legally be excluded, restricted or modified under applicable law.
Where the laws of the consumer's country of residence provide mandatory protections that are more favorable than the provisions of this Policy, those mandatory protections will apply.
